NEW YEAR MILLIONAIRE RAFFLE RULES

1. The Lottery raffle shall be called "NEW YEAR MILLIONAIRE".

2. "NEW YEAR MILLIONAIRE" tickets will be sold from November 1, 2007 until December 31, 2007 or until tickets are sold out whichever comes first.

3. Lottery tickets for "NEW YEAR MILLIONAIRE" raffle will be available at all lottery retailers/agents licensed to sell Tri State lotto tickets and all ticket sales must be made through an on-line machine.

4. The price of a single ticket (wager) shall be $20.00.

5. An agent is entitled to the same commission for raffle ticket sales as is paid for their other Tri-State on-line lottery ticket sales.

6. The retailer/agent(s) selling the winning $1,000,000 "NEW YEAR MILLIONAIRE" ticket shall receive a $10,000.00 retailer incentive from the Lottery. The retailer/agent(s) selling the winning $250,000 "NEW YEAR MILLIONAIRE" ticket shall receive a $2,500 retailer incentive from the Lottery. The retailer/agent(s) selling a winning $1,000 "NEW YEAR MILLIONAIRE" ticket shall receive a $10 retailer incentive from the Lottery.

7. The retailer/agent operated on-line terminal will issue "NEW YEAR MILLIONAIRE" tickets whereby the computer sequentially assigns a pre-determined six (6) digit number from the 200,000 raffle numbers available to the player for $20.00.

      a. Maine's six digit numbers shall be from 100001 - 180000.
      b. New Hampshire's six digit numbers shall be from 200001 - 280000.
      c. Vermont's six digit number shall be from 300001 - 340000.

8. The breakdown per state of the 200,000 raffle tickets will be as follows: Maine - 80,000: New Hampshire - 80,000: Vermont - 40,000.

9. All "NEW YEAR MILLIONAIRE" prizes must be claimed as directed within 365 calendar days of the drawing in which the prize was won. For the purpose of determining the claim period, the first (draw) day shall be excluded and the last day included. In the event the last day falls on a Saturday, a Sunday, or a legal holiday, or other day that the Lottery may be closed, the time to claim shall be extended to close of business on the next day thereafter when Lottery offices are open for business. Any prize not claimed within the specified period shall be forfeited.

10. In the case of an unclaimed ticket, upon the expiration of 365 days after the drawing date, the prize shall revert to the expired unclaimed prize pool.

11. "NEW YEAR MILLIONAIRE" tickets may not be cancelled.

12. There will be no same day cashing in the "NEW YEAR MILLIONAIRE" raffle.

13. It shall be the sole responsibility of the ticket purchaser or holder to verify the accuracy and condition of all data printed on the ticket prior to leaving the establishment where the ticket was purchased.

14. A valid Tri-State Raffle ticket shall contain all of the following:

      a. The name of or a title of reference to, the Raffle game.
      b. The drawing date.
      c. The total ticket price.
      d. A 15 digit validation number
      e. A terminal printed validation bar code.
      f. A vendor security-issued number.
      g. A ticket stock sequential number.
      h. A six digit raffle number assigned by the lottery's computer program.
      i. Retailer number.
      j. Terminal number.
      k. Time stamp.
      l. Text lines available for lottery messages.

15. If for any reason the player's bet is not accepted, then the liability of the party lottery and its agent is limited to a refund of the amount wagered.

16. A winning "NEW YEAR MILLIONAIRE" raffle ticket is a bearer instrument and a claim is deemed to be made by the person presenting the ticket for payment and whose name appears as the claimant on the rear of the ticket and on an authorized Prize Claim Form.

17. All "NEW YEAR MILLIONAIRE" winning raffle tickets must be validated within the state where the ticket was originally purchased.

18. The lottery shall not be responsible for lost, damaged or stolen tickets prior to validation.

19. The drawing to select the winning eight hundred fifty-four (854) raffle numbers for the "NEW YEAR MILLIONAIRE" Lottery will be held and take place at New Hampshire Lottery headquarters on Friday, January 4, 2008 in the presence of the audit firm of Anderson & Clouse or such other firm as may be employed by the Tri State Lotto Commission at that time. The time is to be determined by the Tri-State Lotto Commission..

20. The winning eight hundred fifty-four (854) raffle numbers will be randomly generated by computer means. When the random drawing takes place, the first one (1) raffle number selected from the total field of raffle tickets and their respective raffle numbers sold in all three party states will be assigned to the $1,000,000 prize tier. Subsequently, there will be three separate drawings held for the Tri-State party states to determine the winning numbers for the remaining prizes as follows:

Maine State Lottery: From the remaining raffle tickets sold in their state, one (1) raffle number will be assigned to the $250,000 prize tier, the next twenty (20) raffle numbers will be assigned to the $1,000 tier, and the remaining three hundred and twenty (320) raffle numbers will be assigned to the $250 prize tier.

New Hampshire Lottery Commission: From the remaining raffle tickets sold in their state, one (1) raffle number will be assigned to the $250,000 prize tier, the next twenty (20) raffle numbers will be assigned to the $1,000 tier, and the remaining three hundred and twenty (320) raffle numbers will be assigned to the $250 prize tier.

Vermont State Lottery Commission: From the remaining raffle tickets sold in their state, one (1) raffle number will be assigned to the $250,000 prize tier, the next ten (10) raffle numbers will be assigned to the $1,000 tier, and the remaining one hundred and sixty (160) raffle numbers will be assigned to the $250 prize tier.

21. Prize Pool

      a. The total prize pool will be equal to $2,000,000 (50% of the gross dollars wagered) for said Lottery drawing.

      b. The amount of the prize pool may be supplemented by proceeds from the expired unclaimed prize reserves or any part thereof for purposes of payment of the prize awards at such times and in such a manner, as determined by the Tri-State Lotto Commission.

      c. Prizes for "NEW YEAR MILLIONAIRE" shall be as follows:

      d. Prizes will be paid in a single disbursement.

            1. All payments shall be made to the winner or to his or her estate.

      e. All prizes in excess of $5,000.00 will be subject to federal and state (if applicable) withholding tax at the prevailing tax rate.

22. The holder of the winning million dollar ticket and the $250,000 ticket for the "NEW YEAR MILLIONAIRE" Raffle shall take said ticket to lottery headquarters of the state wherein the ticket was purchased for validation. All remaining prize winning tickets shall be validated at a lottery agent of the state wherein the ticket was purchased.

23. All prizes of $599 or less or amount required by individual party state may be paid directly by lottery sales agents. The claimant shall present his/her ticket to a lottery agent, fill out his/her name and address on the back of the ticket, and show identification as required by individual states. The agent, after verifying that the ticket is a winning ticket and examining it for alteration, shall pay the claimant directly or to his/her authorized representative.

24. The liability of the Tri-State Lotto Commission for tickets printed or produced in error by the vendor or for defective tickets shall be limited to the replacement of the defective ticket with another unplayed ticket by the agent or reimbursement to the holder at the retail sale price of the ticket by the Lottery.

25. All winners, tickets, and transactions are subject to the Tri-State Lotto Commission rules and regulations and State Law. All prize awards are subject to claim procedures, validation tests, and other applicable requirements of the Commission. All persons holding winning tickets must file a claim for a prize within one year of the date of the drawing. One year means the anniversary of the date of the draw unless the draw date is February 29 in which case the anniversary is considered to be March 1.

26. TICKET VALIDATION REQUIREMENTS

      (a) To be a valid ticket and be eligible to receive a prize, all the following requirements must be satisfied:

            (1) The ticket must have been issued by the party lottery through a licensed agent, via a terminal, in an authorized manner. The ticket must be intact and must not be mutilated, altered, reconstructed, or tampered with in any manner.

            (2) The ticket date must have been recorded in the central computer system.

            (3) The information appearing on the ticket must correspond precisely with the party lottery's computer record.

            (4) The fifteen (15) digit validation number must appear in its entirety, and correspond, using a computer validation file, to the winning game play or plays printed on the ticket. The ticket stock sequential number on the back of the ticket must correspond to the party lottery's inventory records.

            (5) The ticket must not be defectively printed, blurred, produced in error, counterfeit in whole or in part, altered, unreadable, reconstructed, tampered with in any manner, stolen, blank or partially blank, misregistered, or defective.

            (6) All information appearing on an apparent winning ticket must correspond to the party lottery's records of winning tickets, and another ticket with identical data shall not have been paid.

            (7) The ticket must be intact, fully legible, complete and not miscut, correspond to the art work on file at the party lottery in every respect.

            (8) The ticket must pass all other security criteria determined by the commission.

            (9) The ticket must be validated in accordance with the provisions of these rules relating to the procedures for claiming prizes and for the payment thereof.

            (10) An apparent winning ticket shall be void unless the ticket is printed on a paper stock roll which was in use at the time of the bet by, and validly issued to, the agent from whom the ticket was purchased.

      (b) In the event that a ticket fails to pass all the criteria set forth in subpart of this rule, the ticket shall be deemed void and ineligible for any prize and shall not be paid. In the event of a dispute or other instance of doubt, the decision of the Lottery director shall be final and binding. If the director determines that the ticket is not eligible to receive a prize, then the director may, at the director's option, replace an invalid, defective or otherwise erroneous ticket with a ticket of equivalent sales price from any current lottery game. Replacement of the ticket shall be the bearer or claimant's sole and exclusive remedy.

27. RETAILERS' CONDUCT

      (a) A lottery retailer authorized to sell lottery tickets for on-line games, or an employee of a retailer, may not request, demand, or accept gratuities or additional compensation from any person, or agent thereof, in exchange for the purchase of Raffle lottery tickets.

      (b) A lottery retailer authorized to sell lottery tickets for on-line games must make the "NEW YEAR MILLIONAIRE" raffle tickets available for sale to the public during the hours that sale of on-line tickets are authorized to be sold and that the retailer's business is open to the public.

      (c) A lottery retailer authorized to sell lottery tickets for on-line games may only sell "NEW YEAR MILLIONAIRE" raffle tickets on the premises described in the retailer's contract, except may be as specially authorized in writing by the director. No transaction, or any part thereof, for "NEW YEAR MILLIONAIRE" raffle lottery tickets may be made at the general corporate office of any retailer unless that office is open to the public and has contracted with the lottery as a separate lottery retailer.

      (d) Location and Method of Sales. An offer to buy and an offer to sell a lottery ticket in a Tri-State on-line game shall be made only at a location or only by a method which is licensed, certified, or contracted by the member lottery.

      (e) No device shall be connected to a lottery terminal to enter plays, except as may be approved by the lottery. (Unapproved devices may be seized by the lottery.)

      (f) All lottery agents, who sell "NEW YEAR MILLIONAIRE" raffle tickets, must service all customers in a timely manner.
